Terms of Service - GymgaPlay.com

1. Acceptance of Terms

By accessing and using GymgaPlay.com (hereinafter "the Platform"), operated by GymGamEnt Ltd, you agree to be bound by these Terms of Service. By using our games (G-Apps), you acknowledge that you have read, understood, and fully accepted these conditions.

 

2. Description of Service

GymgaPlay.com provides interactive, motion-based entertainment services accessible via web browsers on various devices (Win, Mac, iOS, Android). The platform allows users to access a library of games (G-Apps) either in anonymous mode or through social login.

 

3. Account Management and Access

  • Anonymous Mode: Users may play without registration. In this case, progress is not saved on our servers and is limited to the local session.

  • OAuth Access (Gmail, etc.): Login is handled via third-party providers. GymGamEnt does not store emails or passwords; instead, it creates a technical account identified by a unique code (UID) to save records and checkpoints.

  • Responsibility: The user is solely responsible for maintaining the confidentiality of their access credentials provided by third-party providers.

 

4. Physical Safety and Supervision (Crucial)

Given that GymGamEnt games encourage physical interaction and movement:

  • Play Area: The user agrees to play in a safe environment, free of obstacles, sharp-edged furniture, or fragile objects.

  • Supervision of Minors: Use of the Platform by children under the age of 14 must occur under the constant supervision of an adult, who must ensure that the minor does not perform dangerous or excessive movements.

  • Health: The user declares they are in suitable physical condition for the motor activity required by the game. GymGamEnt Ltd is not responsible for injuries, pain, or physical damage resulting from improper use or excessive intensity while playing.

 

5. User Conduct

  • Nicknames: The use of offensive, discriminatory nicknames, or those containing personal identifying information (e.g., real First and Last Name) is prohibited.

  • Lawful Use: It is forbidden to attempt to hack, tamper with, or circumvent the ranking systems or the GymGamEnt Editor.

 

6. Intellectual Property

All content, games (G-Apps), React code, web player, and interaction technologies (including the V.I.T.R.U.V.I.A.N. system and JSON files generated by the Gymga Editor) are the exclusive property of GymGamEnt Ltd or its licensors and are protected by international copyright laws.

 

7. Limitation of Liability

To the maximum extent permitted by law, GymGamEnt Ltd shall not be liable for:

  • Material damage to devices or surrounding environments during gameplay.

  • Service interruptions due to technical network issues or Firebase/Google Cloud server failures.

  • Loss of game data for users operating in "Anonymous" mode.

 

8. Modifications and Termination

We reserve the right to modify these Terms at any time to adapt to new technologies or regulations (e.g., DSA, AI Act). Continued use of the Platform after the publication of changes constitutes acceptance of the new terms.

 

9. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales (or the laws of the user's country of residence for EU consumers, where applicable). Any disputes shall be subject to the exclusive jurisdiction of the competent courts.
